We act as your friend, guide and facilitator all through your visit that is from the moment you reached an Indian port of entry, through your treatment, holidaying, to your return trip.

The terms and conditions below spell out the agreement documentation that comes into force once you accept them and start using MediEase services.

Outline

By using MediEase’s online Web site for Medical Tourism, you thereby agree to be bound by all of the terms and conditions contained in this User Agreement ("Agreement"). www.medieaseindia.com

Company ("MediEase") reserves the right at its discretion to change the Terms of this Agreement whenever it deems necessary and notifies the changes through online. Your continued use of MediEase’s Online Web site after the posting of notice of any such change shall constitute your agreement to be bound by such changes.

Definition

www.medieaseindia.com includes all medical portal sites owned and operated by MediEase.

Booking Medical Treatment In India On Behalf Of The Patient

The Patient or the Patient’s relatives / escorts / friends who make the booking on behalf of the Patient shall carefully read the terms and conditions mentioned herein before filling up and signing on the registration form. The terms and conditions as set out in the registration form and in the Package quote, a copy of which has been provided to the Patient or the person who does the booking on behalf of the Patient. The Patient and the person who does the booking on behalf of the Patient shall sign this document. The signing of the document of terms & conditions by the Patient and the person who does the booking on behalf of the Patient shall imply total acceptance of the terms and conditions contained herein. The signed terms & conditions documents along with the receipt of payment shall be binding on the Patient and the person who does the booking on behalf of the Patient and shall constitute a contract between MediEase and the Patient as well as the person who does the booking on behalf of the Patient.

MediEase (Medical Tourism operator in India), directly or indirectly, does not control or operate any Medical Institution that include any diagnostic, treating or nursing center, neither does it operate or control any facility or service provided by the Medical Institution mentioned in the Package.

Although, MediEase takes care in selecting all the elements in the Package and has no control whatsoever in running the Medical Institution and hence, MediEase cannot be made liable / responsible for any delay, default, failure, improper services / deficiency in services provided by the Medical Institution and/or for any injury, sickness, accident, discomfort, death, loss or damage of any kind whatsoever which may arise due to any act of negligence, deficiency or default in services, of the management or employees of the Medical Institution.

The Institution That Undertakes The Treatment

The Medical Institution shall be solely responsible for all treatments to be provided by it to the Patient, including but not limited to surgical, medical, wellness, beauty and all related queries, opinions, advices, and instructions and MediEase shall not be responsible for the same. The Medical Institution, and not MediEase shall be responsible for the success, failure and complications with regard to all the medical procedures vis-à-vis the treatments undergone by the Patient.

Any emergency, complication or medical requirement, of whatsoever nature, arising with regard to the Patient’s treatment due to the Patient’s present or past illness or the side effects / allergy of / to drugs or lack of adequate treatment, pre, during or post treatment will be the sole responsibility of the Medical Institution and / or the consulting Doctor, as the case may be, and MediEase shall not be responsible for the same.

If the Patient and the person who does the booking on behalf of the Patient has any complaint in respect of the services rendered by the Medical Institution, he / they should forward such complaints directly to the Medical Institution without any recourse to MediEase Hospitality Services.

MediEase Travel Services

You can combine any or all travel services offered by MediEase that includes airport transfers, limo Services, hotel booking, guest house booking, service apartment booking, local conveyance and travel, translator/interpreter services, recuperative holidays and more with your Medical tour package and MediEase would be pleased to provide you the same.

MediEase Healthcare Packages

The Healthcare packages offered by MediEase in association with the premier Healthcare providers in India will be provided on the following Terms and Conditions.

(A) Quotation Estimate & Payment Mode

MediEase arranges for you complementary initial consultations through e-mail with the Medical professional after he/she receiving your medical history form and diagnostic reports. You are advised to ask the consultant during the consultations, all the queries you may have.

MediEase emphasizes that any medical procedures, transplants, replacements surgical or otherwise, carry certain risks and hence MediEase suggests that you and your consultant have to agree about the expected outcome of the procedure to be undertaken.

After the preliminary pre-treatment e-mail consultations and evaluation of your medical records, MediEase would send you a quote indicating the cost of the procedure. The quotation would include only the services detailed in it. Later, during the face-to-face consultations, or the subsequent pre-treatment medical examination or diagnostic report, if any unexpected costs appear, such costs will be detailed and presented to you for your authorization and consent.

Before the commencement of the procedure, the patient is required to pay for full cost to the Medical Institution through MediEase to book services on firm basis that include, room, operation theatre etc. The paid cost would not include Insurance and other additional medical expenses for any medications or procedures in case of unanticipated medical complications. You are advised to discuss this with your Doctor before the procedure and advised to take medical as well as travel insurance before arriving into India for your medical treatment.

International Airfare / International Or Domestic Air Tickets / India Visa etc. Are Not Included In The Quotation.

Stages of Payment: The quoted amount is to be paid in two instalments as indicated here.

• Along with your consent for the treatment – 25% of the total amount quoted in Advance (Non- refundable).
• 30 days prior to your arrival in india - the remaining 75% of the total quotation estimate.

In certain critical cases it is compulsory to pay full amount for booking medical treatment / procedure services on emergency basis. In such cases, it is binding on the patient to pay MediEase full advance payments.

MediEase’s Cancellation Policy:

Refund

The refund of unused / unutilized services (which are paid for and cancelled in advance), if any, would be worked out on the basis of the above cancellation policy and the money would be accordingly refunded to the person who has made the payment to us. Please note that the refund process may take up to 35 days due to Indian banking procedures.

MediEase Holiday Services

MediEase’s Holidays division shall not be responsible for any delays & variations in the program or expenses incurred thereof- directly or indirectly - due to natural hazards, flight cancellations, accident, breakdown of machinery or equipments, breakdown of transport, weather, sickness, landslides, political closures or any other untoward incident. MediEase shall not be responsible for any loss, injury or damage to person, property, in connection with any accommodation, transportation or other services, resulting - directly or indirectly - from any act of GOD, dangers, fire, accident, breakdown in machinery or equipment, breakdown of transport, wars, civil disturbances, strikes, riots, thefts, pilferages, epidemics, medical or custom department regulations, defaults, or any other causes beyond our control.

The itineraries are illustrative itineraries, intended to give you a general idea of the likely travel schedule and many factors such as weather, road conditions, the physical ability of the patient etc. may dictate itinerary changes either before or during the tour. We reserve the right to change any schedule in the interest of the trip Patient’s safety, comfort, general well being and convenience.

We do not provide any insurance coverage of the expenses caused by accident, sickness, theft, or any other reasons. Visitors are advised to seek such insurance arrangements in their home country before commencing travel.

If the rates quoted by hotel and airlines are changed, we change the rates quoted based on such modifications without any prior notice. All hotel bookings are based on the check in and check out timings of the hotels.

Indemnity

You agree to indemnity and hold MediEase, it’s proprietor, subsidiaries, affiliates, officers, agents and other partners & employees harmless from any loss, liability, claim or demand, including reasonably attorney fees made by any third party due to or arising out of your use of the service in violation of this agreement and / or any breach of your representation and warranties set forth above.

Discrepancies And Disputes

In case of Medical discrepancy or conflict for immutability of malpractice carried out by the patient, all the concerned parties establish and agree that all judicial action must be carried out by the patient towards the medical professional / healthcare center / hospital only within the jurisdiction of Bangalore, State of Karnataka, India, and that action will not be extended towards www.medieaseindia.com, it’s managing company MediEase or any of it’s proprietor / Directors / Managing Director and employees since it is a company that puts at the disposition of the patient different professional options through listing their services without exercising / practicing medicine professionally. If there is any dispute about or involving the web site and / or the service, by using this web site, you agree that the dispute will be governed by the laws of the State of Karnataka, India without regard to it’s conflict of law provisions. You agree to personal jurisdiction by and venue in the state and central courts of Bangalore, India.

Acceptance Of These Terms

By using the medical services offered by MediEase you signify your acceptance to our terms and conditions, if you do not agree with these terms and conditions, please do not sign these agreements of Terms & Conditions documents.
